INTRODUCTION AND GOVERNING LAW
These are the Terms & Conditions of Sale applicable to on-line purchases from Newport Florist Pty. Ltd. ("Newport Florist").
These terms and the laws of New South Wales, Australia, apply to all transactions for the purchase of products ("Products") from Newport Florist through its website at http://www.newportflorist.com.au and any associated web page (the "Site"). These terms represent the complete Agreement between Newport Florist and the Buyer covering the sale of Products from this Site. The Buyer's completion of the Order form on this Site will constitute an offer to the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by Newport Florist.
PRICES
The prices to be paid by the Buyer for all Products will be Newport Florist's current selling price on the date of receipt by Newport Florist of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as calculated at the Checkout.
Newport Florist reserves the right to change its prices from time to time without prior notice to the Buyer. All prices in this website include Australian Goods and Services Tax (GST) at 10%.
The GST payable by the Buyer will be shown on the invoice, which Newport Florist will send to the Buyer. Delivery charges to the nominated address will be advised to the Buyer on the delivery screen and Order confirmation pages of the Site.
STOCK AVAILABILITY AND VARIATION
Whilst every effort is made to match pictures shown or described on the website or in sample books, actual items and arrangements may not be exactly as shown and are subject seasonal and market availability and, accordingly, Newport Florist reserves the right to substitute items ordered. Newport Florist will attempt to contact customers where substantial differences are envisaged.
CURRENCY
All prices on Newport Florist are listed in Australian dollars (AUD).
ALCOHOL
All alcoholic products offered for sale by Newport Florist are NOT available to persons under the age of 18 years and are not available for delivery to persons under the age of 18.
ORDER DELIVERY AND CANCELLATION
All Orders by the Buyer under this Agreement must be placed via the forms provided on this Site and must specify the information requested, including (but without limitation):
(a) Quantity and description of Products
(b) The full street address to which the Product is to be delivered
(c) Current billing address to which statements are sent.
The Buyer must complete all information requested on the Order form before the Order is processed by Newport Florist.
Newport |Florist will not accept orders:·
(a) From trade customers who are buying Products for resale;
(b) If the Buyer does not offer to pay by one of the payment means listed in this website; or
(c) If the Buyer's credit provider does not confirm the payment.
Newport Florist will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If Newport Florist does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.
DELIVERY
Delivery of a Product will occur between 2-6 business days after acceptance of an Order. A Buyer cannot arrange collection of Orders from Newport Florist either in-person or via alternative courier.
The Buyer acknowledges that Newport Florist may, from time to time, be subject to delays and shortage in supply and production, delivery or other unforeseen delays and that Newport Florist may allocate distribution of Products ordered among its customers at its sole discretion.
If Buyer's Order has not been delivered within a reasonable time, the Buyer should contact Newport Florist at: info@newportflorist.com.au
If no one is available at the delivery address to receive the Products, Newport Florist's delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products. Newport Florist reserves the right to make partial delivery of an Order.
PAYMENT
Payment for Products purchased from Newport Florist via the Site can be made only by payment means specified on the Website.
Newport Florist will verify information submitted by the Buyer for the credit card or other payment method and will advise the Buyer that its Order has been accepted. The Buyer agrees to submit to Newport Florist, via the website’s payment gateway, such information as may be reasonably requested by Newport Florist for the authorization and verification of its credit card or other payment method.
Newport Florist reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer's credit card or other payment method provider. In particular, but without limitation, if the Buyer's credit card or other payment method provider rejects a payment when due, Newport Florist at its discretion may delay or cancel delivery of Orders placed by the Buyer.
Newport Florist may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to Newport Florist.
CANCELLING AN ORDER
If the Buyer wishes to cancel an Order prior to shipment, the Buyer must contact Newport Florist on 02 and/or e-mail info@newportflorist.com.au Newport Florist will endeavour to accommodate the Buyer's request, if the merchandise has not been made up or shipped.
If the Buyer's entire order is cancelled prior to shipment Newport Florist will apply a credit to the Buyer's credit card or other payment means and may also apply a cancellation fee.
FREIGHT METHODS
Newport Florist will arrange delivery of all Products to the Customer using its nominated freight carriers. A Buyer must not arrange its own courier to collect the Products from Newport Florist without prior agreement.
DELIVERY OUTSIDE AUSTRALIA
Newport Florist is able to accept Orders or deliver to addresses outside Australia through its international affiliates.
PRIVACY
If we collect your personal information we do so in accordance with our Privacy Policy available on this website. The Privacy Policy explains how we manage your personal information in accordance with the National Privacy Principles in the Privacy Act 1988.
FRAUD
Any party engaged in illegal activities involving the use of this website will be subject to civil and criminal sanctions and prosecution. Newport Florist does not guarantee that it will be able to prevent any illegal or inappropriate use of this website, nor that it will give notice of any illegal or inappropriate use of this website. It is an illegal violation to place orders under a false name, with a fraudulently obtained credit card or other payment means or without the consent of the cardholder or payment facility. All persons found to have placed a fraudulent order will be prosecuted.
